Ch. 576 LAWS OF MARYLAND

37.

(a) (6) (I) Each classified employee [, upon termination from the classified]
WHO TERMINATES service ON OR AFTER JULY 1, 1990 FOR REASONS other
than [by] retirement shall forfeit any accumulated sick leave.

(II) Upon termination PRIOR TO JULY 1, 1990, OR UPON
TERMINATION by retirement ON OR AFTER JULY 1, 1990, each classified
employee is entitled to have [his] accumulated sick leave days added to [his] THE
EMPLOYEE'S creditable service for the purposes of determining [his] retirement
benefits under Article 73B of [this] THE Code.

(III) A State employee who came into the State system while retaining
sick leave and annual leave benefits under a county system and who came under the
provisions of Chapter 423 of the Acts of 1971 shall be entitled to the same full credit
toward retirement as provided by this section.

Article 73B - Pensions

(6) (a) Upon verification to the board of trustees a member at the time of
retirement shall receive membership service for unused sick leave in accordance with
the formula that 22 days of unused sick leave are equal to one month of membership
service. One additional month of membership service shall be granted if fractional days
totaling 11 or more result from the application of this formula.

(b) For the purpose of this paragraph, no more than 15 days of sick leave
of any member may be accumulated annually.

(c) For the purposes of this paragraph, if an employer provides an annual
sick leave allowance in excess of 15 days, the days of sick leave actually used in any year
shall first be charged against accumulated leave to the extent of the excess.

(D) A MEMBER WHO TERMINATES SERVICE FOR REASONS
OTHER THAN RETIREMENT PRIOR TO JULY 1, 1990, AND WHO IS
OTHERWISE ENTITLED TO A VESTED RETIREMENT ALLOWANCE, MAY
RECEIVE CREDIT FOR UNUSED SICK LEAVE REPORTED BY THE
MEMBER'S EMPLOYER AT TIME OF TERMINATION OF EMPLOYMENT.

[(d)] (E) Sick leave membership services shall not be used to determine
years of membership service required for the following:

[(!)] (I) Death benefit;

[(2)] (II) Ordinary disability;

[(3)] (III) Vesting of employer contributions;

[(4)] (IV) Early retirement; or

[(5)] (V) Average final compensation.
