(House Bill 83)

AN ACT concerning

Howard County - Alcoholic Beverages - Enforcement
Ho. Co. 15-90

FOR the purpose of exempting Howard County from a provision that prohibits an
alcoholic beverages law enforcement or licensing authority from proceeding
against an alcoholic beverages licensee that has received "probation without a
verdict"
probation before judgment, or whose employee has received "probation
without a vordict"
probation before judgment, for certain violations relating to
prohibited sales of alcoholic beverages; and making certain stylistic changes.

BY repealing and reenacting, with amendments,

Section 118(a)

BY adding to

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

118.

(a) (1) A licensee [under the provisions of this article,] LICENSED UNDER
THIS ARTICLE, or any [of his employees] EMPLOYEE OF THE LICENSEE, may
not sell or furnish any alcoholic beverages at any time to a person under 21 years of
age[, either for his]:

(I) FOR THE UNDERAGE PERSON'S own use or for the use of
any other person[, or to]; OR

(II) TO any person who, at the time of the sale, or delivery, is visibly
under the influence of any alcoholic beverage.

(2) Any licensee or any [of his employees] EMPLOYEE OF THE
LICENSEE who is charged with a violation of this subsection shall receive a summons
[for his appearance] TO APPEAR in court on a certain day to answer the charges
