Mr. Gordon chairman of the special committee, made the
following report:

To the Speaker of the House of Delegates :

The Special Committee to whom was referred the resolution
offered by Lewis P. Fiery, a Delegate from Washington coun-
ty, beg leave to report as follow:

That at an election held on the first Wednesday of Novem-
ber, 1859,

Charles L. Krafft, Thomas Booze,

Robert L. Seth, George R. Berry,

Frederick C. Crowley, Robert A. McAllister,

Thomas M. Smith, Robert Turner,

William A. Wisong, Marcus Denison,

Were returned by the judges of said election as persons elec-
ted as Delegates to the House of Delegates of Maryland.
That all of said parties, except said Wisong, appeared and
took their seats as members of said House, on the first Wed-
nesday of January, 1860.

That the right of said parties to seats in said House, was
afterwards contested before said House by other parties, who
claimed to be entitled to said seats.

That said House after taking a large amount of testimony
through its Committee on Elections, adopted the following
resolution :

".Resolved, That it appears to this House, that there were
such tumult, riot, intimidation, fraud and injustice in the
election of Delegates from the city of Baltimore on the 2nd
of November last, in contempt of law and in violation of the
freedom of elections, that the said election is void, and that
the Speaker of the House of Delegates issue his warrant for
the election of ten Delegates to represent Baltimore city in
the present General Assembly, on Saturday the 10th day of
March next."

That the Speaker" of said House did immediately thereon
issue his warrant to the Sheriff of Baltimore city for an elec-
tion of Delegates as he was thereby directed.

That the Governor of this State, regarding the extraordi-
nary emergency, and the necessity for an immediate session
of the Legislature then existing, issued his Proclamation on
the 21st day of April last, convening the two Houses in ex-
tra session on the 26th day of April, only five days . after the
issuing of his Proclamation.
