Forfeiture.
|
requirements of this Act, and shall be so re-
ported to the County Commissioners they shall
forfeit one-twelfth of the yearly proportion
of their contract; and the said Road Commis-
sioners and County Commissioners shall so
regulate the amount of contracts awarded and
limit all other expenditures for road and
bridge purposes in Cecil county as not to ex-
ceed in the aggregate for any one year an
amount equal to twenty cents on each one hun-
dred dollars of the taxable basis of said county;
provided, that this shall not apply to extra-
ordinary expenditures required on account of
great damage by storms or floods.
SEC. 5. And be it enacted, That the contract-

ors under the aforegoing section shall be
known as Road Supervisors; and it shall be
the duty of said supervisors to keep the roads
in their charge at all times in good repair, so
as to afford free, safe and easy passage over
the same; said roads to be free from all over-
hanging and projecting limbs or bushes, from

all ruts, holes, loose stones, brush and rub-
bish of every kind whatsoever, higher in the
centre than at the sides, except when other-
wise ordered by the County Commissioners,
and with clear, open ditches of sufficient
capacity and grade to carry off the water; the
supervisors shall give prompt notice to the
Road Commissioner in charge of their road
district of any injury done to the bridges on
the roads in their charge, and also of any un-

lawful obstruction placed on said roads; and
any supervisor failing to perform the afore-
going duties shall be liable to indictment by
the Grand Jury, and upon conviction, shall be
fined not more than one hundred nor less than
twenty-five dollars with costs, and if the same
cannot be recovered from the said supervisor
his bond shall be liable for the payment
thereof, the fine to be paid into the County
Treasury to the credit of the road and bridge
account; and the County Commissioners, in
their discretion, may upon the complaint to
