SEC. 3. And be it enacted, That this act shall
take effect on the first day of July, eighteen
hundred and eighty-six.

Approved April 7, 1886.

CHAPTER 498.

AN ACT to repeal section two hundred and
fifty of article ninety-three of the Code of
Public General Laws, title "Testamentary
Laws," sub-title "Orphans' Court/' and to
re-enact the same with amendments.

Effective.

SECTION 1. Be it enacted by the General As-
sembly of Maryland, That section two hun-
dred and fifty of article ninety-three of the
Code of Public General Laws, title "Testa-
mentary Laws," sub-title "Orphans' Court," be
and the same is hereby repealed and re-enacted
so as to read as follows :

SEC. 250. On such plenary proceeding, if the
deposition shall be taken in writing and re-
corded, and if either party require it, the Court
shall direct an issue or issues to be made up
and sent to any Court of Law convenient for
trying the same, and the issue shall be tried
in the said Court of Law as convenient, with-
out any continuance longer than may be

necessary to procure the attendance of witness;
and the power of the Court of Law and the pro-
ceeding thereto relative shall be as directed
by law respecting the trial of issues, and the
Orphans' Court shall give judgment or decree
upon the bill and answer and depositions or

of contest award costs, in their discretion, and
compel payment by attachment and fine, or by
attachment and sequestration, or by fieri
facias.
