SEC. 3. And be it enacted, That the Judges
of the Election in the several election districts
shall carefully ascertain the number of votes
cast in their respective districts for the sub-
scription to the Delaware and Chesapeake Rail-

way, and the number of votes cast "Against
the subscription to the Delaware and Chesa-
peake Railway," and the several Return Judges
shall make two returns thereof, attested by
their hands and seals, to the Clerk of the
Circuit Court for Caroline county, and said
Clerk shall send a copy thereof under the seal
of his office, to said County Commissioners.
SEC. 4. And be it enacted, That if, from the
returns made by the Judges of the Election, as
certified by the said Clerk, it shall appear to the
County Commissioners of said county, that a
majority of the votes were cast in favor of the
subscription to the capital stock of the Dela-
ware and Chesapeake Railway, a majority of
the said County Commissioners of said county
are hereby authorized and directed to sub-
scribe in behalf of said county, for the capital
stock of the Delaware and Chesapeake Rail-
way to the amount of forty thousand dollars,
and for the purpose of paying said subscrip-
tion, to issue the bonds of the county in such

sums, and redeemable in such time or times
within forty years, with coupons thereto at-
tached, bearing four per cent, interest per an-
num, payable semi-annually, and to sell the
said bonds and apply the proceeds of such
sales in payment of the stock so subscribed
for by them; provided, that no bonds shall be
sold for less than the par value thereof; and
provided, further, that no bonds shall be sold
and no money paid until the said lateral branch
road shall have been constructed as aforesaid,
and trains running thereon.

SEC. 5. And be it enacted, That the said
County Commissioners shall levy on the tax-
able property of said county, such sum or sums
of money as shall in their discretion be needed
|
Levy to pay.
