using the streets or highways of Baltimore
city, either the surface or the ground beneath
the same, obtain a special grant from the
General Assembly of Maryland, and the assent
and approval of the Mayor and City Council
of Baltimore city.

SEC. 3. And be it enacted, That this act shall
take effect from and after the date of its pas-
sage.

CHAPTER 162.
AN ACT for the more complete and efficient
organization and discipline of the uniformed
volunteers constituting a portion of the en-
rolled Militia of the State, to be enlisted, or-
ganized and maintained as herein directed,
and to be known as the "Maryland National
Guard."
SECTION. 1. Be it enacted by the General As-
sembly of Maryland, That out of the vol-
unteer uniformed organizations already exist-
ing and those hereby created, there shall be

formed a body of active militia, to consist of
not more than thirty-eight companies and to
contain not more than twenty-two hundred and
eighty enlisted men, to be enlisted, organized
and maintained as hereinafter provided, to be
known as the "Maryland National Guard," and
to be located and distributed throughout the
State as follows :
SEC. 2. And be it enacted, That said entire
force shall be formed and organized into one
brigade, and until otherwise provided by the
General Assembly, shall consist of the fol-
lowing organizations, to wit: The Fifth Regi-
ment, the Baltimore Light Infantry, three
