benefited by such improvements for the ap-
portionment among them of the amounts of
such damages and expenses so determined to
be levied upon them in due proportion to the
amount of benefits by them respectively re-
ceived; to provide for the appointment of
two or more Commissioners, who when sworn,
shall be authorized to value and assess said
damages and benefits upon and among said
property holders accordingly, and to prescribe
the duties and the compensation of said Com-
missioners; to provide for the condemna-
tion of all land and property so taken for pub-
lic use in laying out, opening, extending, alter-
ing or widening any road, street or alley as
aforesaid; to provide for the notice to be
given in relation thereto for the payment of the
damages to the respective parties so awarded,
and for the collection and mode of pay-
ment of the benefits so assessed by said Com-

missioners, which, when not paid on demand,
may be recovered against the several parties
liable thereto, by the said Mayor and Common
Council in any action allowed by law, and with
power to pass all ordinances necessary and
proper to the exercise and enforcement of the
powers granted in this section; provided, that
if any person or persons owning lands or prop-
erty taken or condemned for public uses un-
der the powers vested in the said Mayor and
Common Council by this section may feel
themselves aggrieved or be dissatisfied with

State of Maryland in and for Carroll county,
resident in said town of Manchester, and if
