AN ACT to repeal section twenty-one of the acts
|
|
|
|
passed at the January session eighteen hundred and
|
|
|
|
seventy-eight, chapter two hundred and fifty-nine,
|
|
|
|
relating to " wild fowl," and to enact the following
|
|
|
|
in lieu thereof, and in lieu of section twenty-one of
|
|
|
|
the original act :
|

|
|
SECTION I. Be it enacted by the General Assembly
|
|
|
|
of Maryland, That section twenty-one of chapter two
|
|
|
|
hundred and fifty-nine, of the acts passed at the Jan-
|
|
|
Repealed and
|
uary session eighteen hundred and seventy-eight, re-
|
|
|
re-enacted in
lieu.
|
lating to " wild fowl," be and the same is hereby
|
|
|
|
repealed, and the following is enacted in lien thereof,
|
|
|
|
and in lieu of section twenty-one of the original act,
|
|
|
|
so as to read as follows:
|
|
|
|
SEC. 21. That no person holding a license to gun
|
|
|
|
for or after wild water fowl shall, during the gunning
|
|
|
|
season as fixed by this act, be allowed to anchor or
|
|
|
|
otherwise make stationery any sink-box, sneak-boat or
|
|
|
|
any other vessel or craft on the waters lying north-
|
|
|
|
ward of the line named in section one of this act, on
|
|
|
|
any Tuesday, Thursday, Saturday or Sunday prior to
|
|
|

the first day of January, of said gunning season, and

on and after the said first day of January, on any
|

Tuesday, Thursday or Sunday, nor until the hour of

five o'clock a. m., on the morning of the day next

succeeding each of said days above specified, and no
|
|

person holding a license as above described, and en-
|
|
|
|
gaged in gunning for wild water fowl, shall go on or
|
|
|
|
over said waters with sink-box, sneak-boat or other
|
|
|
|
vessel or craft before the hour of five o'clock, a. m.,
|
|
|
|
on the morning of the day next succeeding each of
|
|
|

said days as above specified; and any person violating
|

|
|
this section shall be fined not less than twenty-five
|
|
|
|
dollars, nor more than fifty dollars, to be recovered
|
|
|
|
before a justice of the peace as debts of like amount
|
|
|
|
are recoverable, one-half of said tine to be paid to
|
|
|
|
the officer making the arrest, and the other half to
|
|
|
|
those assisting in making the arrest. And in addition
|
|
|
|
to said fine, the person or persons violating this law,
|
|
|
