AN ACT to repeal section two hundred of article
|
|
|
|
one of the Code of Public Local Laws, entitled
|
|
|
|
" Allegany county," sub-title " Surveyor," and to
|
|
|
|
re-enact said section with amendments.
|
|
|
|
SECTION 1. Se it enacted by the General Assembly
|
|
|
|
of Maryland, That section two hundred of article
|
|
|
|
one of the Code of Public Local Laws, title " Alle-
|
|
|
Repealed and
re-enacted.

the act of eighteen hundred and eighty-two, chapter
|
|
|
|
three hundred and three, be and is hereby repealed
|
|
|
|
and re-enacted, to read as follows :
|
|
|
|
200. The surveyor of Allegany county shall be en-
titled to charge for his individual services, under war-
|
|
|
|
rant of survey or resurvey directed from the land
|
|
|
|
office, under orders or warrants of resurvey directed
|
|
|

from the courts of law, and under orders from courts

tled to charge.

of equity, a per diem of five dollars for each day he
|
|
|
|
may be necessarily engaged in performing the duty
|
|
|
|
the said orders or warrants enjoin on the said sur-
|
|
|

veyor; and in case it shall be necessary for the said
|
|
|
|
surveyor, in performing his duties in any of said cases,
|
|
|
|
to survey under ground in coal, ore or other mines,
|
|
|
|
he shall be entitled to charge a per diem of seven dol-
|
|
|
|
lars for each day he may be so engaged surveying
|
|
|
|
under ground; and where the same shall be required
|
|
|
|
by the person for whom the service is rendered, the
|
|
|
State account.

surveyor shall state his account of such services under
|
|
|
|
oath; and the said surveyor may demand bis per
|
|
|
|
diem for his services at the end of each and every day
|
|
|
|
of the rendering of such service, from the person for
|
|
|
|
whom the same is rendered; and if such party or
|
|
|
|
parties refuse to pay the same, may decline and refuse
|
|
|
|
to render any further service in the matter until such
|
|
|
|
demand is complied with.
