Chapter 303.

|
AN ACT to repeal chapter three hundred and thir-
|
|
|
|
teen of the acts of the General Assembly of Mary-
|
|
|
|
land, passed at the session of eighteen hundred and
|
|
|
|
seventy-four, entitled "An act to repeal and re-enact
|
|
|
|
with amendments the twenty third section of the
|
|
|
|
forty-first article of the Code of Public General
|
|
|
|
Laws, title ' Fish and Fisheries,' sub title ' Patux-
|
|
|
|
ent,' " and to re-enact the same with amendment.
|

|
|
SECTION 1. Be it enacted by the General Assembly
|
|
|
|
of Maryland, That chapter three hundred and thir-
|
|
|
|
teen of the acts of the General Assembly of Maryland,
|
|
|
|
passed at the session of eighteen hundred and seventy-
|
|
|

four, and entitled "An act to repeal and re-enact with
|
|
|
re-enacted.

amendments the twenty-third section of the forty-first
|
|
|
|
article of the Code of Public General Laws, title ' Fish
|
|
|
|
and Fisheries,' sub-title ' Patuxent ' " be and the same
|
|
|
|
is hereby repealed and re-enacted so as to read as
|
|
|
|
follows :
|
|
|
|
SEC. 23. No person shall stake down any seine or
|
|
|

net entirely across the Patuxent river for the purpose

|

of taking shad or herring; nor shall any person whip,
|
|
|

thresh or beat the waters of the Patuxent river with
|
|
|
|
poles or any other instrument, for the purpose of driv-
|
|
|
|
ing any fish within any seine or net; nor shall any
|
|
|
|
person or persons, except bona fide residents of Prince
|
|
|
|
George's, Charles, St. Mary's, Anne Arundel and Cal-
|
|
|
|
vert counties, in fishing in the said river, between the
|
|
|
|
fifth day of March and the fifteenth day of May, use
|
|
|

any seine or net with meshes of less size than one and

|
|
|
one-half of an inch square, or during the rest of the
|
|
|
|
year with any seine or net with meshes of a less size
|
|
|
|
than two inches square, and no person shall empty
|
|
|
|
any seine except in water twelve inches deep, and any
|
|
|
|
person violating this section shall be subject to the
|
|
|
|
fine and forfeiture provided in the twenty-second sec-
|
|
|
|
tion of this article.

|
|
SEC. 2. And be it enacted, That this act shall take
|
|
|
