2. In all trials upon indictment or presentment in


any court of this state having criminal jurisdiction, it


shall be lawful for any party accused, or the state's at-

WHEREAS Marcus M. Fazenbaker was, by the gov-


ernor, appointed and commissioned a justice of the


peace in election district number four, in and for Gar-


rett county, Maryland; and whereas there was no pro-


vision by law for the appointment of more than one

as justice of the peace in said district since the first
