Chapter 97.

AN ACT to repeal sub-section ninety-five of chapter

one hundred and eight of the acts of assembly

passed at the session of eighteen hundred and sev-

enty-eight, entitled "An act to add an additional

section to the Code of Public Local Laws, to be

entitled ' Garrett county,' sub-title ' Town of Grants-

ville,' " and to re-enact said section with amendments.

SECTION 1. Be it enacted by the General -Assembly

of Maryland, That sub-section ninety-five of chapter

one hundred, and eight of the acts of the general

assembly passed at the session of eighteen hundred

article to the Code of Public Local Laws, to be en-

titled 'Garrett county,' sub-title 'Town of Grants-

ville," be and is hereby repealed and re-enacted to

read as follows :

SEC. 95. Be it enacted, That all fines and forfeitures

under the ordinances of said corporation shall be re-

coverable as small debts are recovered, before any

justice of the peace, who shall issue his civil writ

against the defendant, and thereafter proceed as in

civil cases; or he shall issue his warrant, as in crimi-

nal cases, against the defendant, and shall commit the

said defendant, if found guilty, to the town lockup, in

default of the payment of his fine and costs, until said

fine and costs are paid, not to exceed ten days; but

the said town commissioners may at any time remit

the said fine and costs, if they shall see proper so
