repealed and re-enacted with amendments to read as
follows:

723. The County Commissioners are authorized and
directed to levy for and pay to the sheriff of Frederick
County, annually, the sum of((Twenty-two Hundred and
Fifty Dollars ($2250. 00) in equal monthly installments, as
full compensation, in lieu of all fees, emoluments and other
compensation, in addition to lodging furnished to himself
and family, for the discharge of his official duties connected
with the administration of said office, as well as such duties
as may be required of him by law, including his care, labor,
responsibility and expense, in keeping the prisoners com-
mitted to his custody safely in jail, and in having the sup-
plies and provisions furnished him by the said commis-
sioners cooked and served to said prisoners.

The Sheriff of Frederick County is hereby empowered
and directed to appoint an office deputy, two riding depu-
ties, and a warden or turnkey. The salaries of the afore-
said office deputy, riding deputies and warden or turnkey
shall be approved by the County Commissioners of Freder-
ick County and paid out of the fees of the Sheriff's office;
in the event, however, that such receipts are insufficient to
meet said salaries, the County Commissioners are author-
ized and empowered to levy for and pay the necessary sum
or sums to meet and pay the same.

All surplus funds in said Sheriff's office, resulting from
fees, etc.. after the payment of the aforesaid salaries, neces-
sary and proper office and traveling expenses as may be
approved by the said County Commissioners, shall be paid
over by the said Sheriff to the Treasurer of Frederick
County, to be used for County purposes.

Nothing in this section shall prevent the Sheriff from
appointing such additional County deputies as, in his dis-
cretion, may be necessary; but the compensation of said
additional deputies shall be paid solely from the fees as
now provided by law.

SEC. 2. And be it further enacted, That this Act shall
not apply to the present incumbent in the office of Sheriff
of Frederick County but shall apply to all Sheriffs of said
County hereafter elected or appointed to succeed the said
present incumbent.

SEC. 3. And be it further enacted, That this Act shall
take effect June 1, 1933.
