of said county to produce funds for expenditure on the
roads of said county; and

WHEREAS, By an Act of the General Assembly of 1933
funds for said roads will be hereafter provided by and ex-
pended by the State Roads Commission; and

WHEREAS, As a result of said Act of 1933 the funds pro-
duced by the said levy of said County Commissioners for
road purposes will not be used therefor; now, therefore,

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the County Commissioners of Garrett
County be and they are hereby prohibited from expending
for road purposes of said county the funds received by said
County Commissioners from the county tax levy made in
April, 1932, and that said County Commissioners be and
they are hereby authorized, directed and empowered to
credit said funds to the general funds of said county and
to use the same for reducing the tax levy about to be made
by said County Commissioners in April, 1933.

SEC. 2. And be it further enacted, That this Act is here-
by declared to be an emergency law and necessary for the
immediate preservation of the public health and safety,
and being passed by a yea and nay vote, supported by
three-fifths of all the members elected to each of the two
Houses of the General Assembly, the same shall take effect
from the date of its passage.

CHAPTER 437.

AN ACT to repeal and re-enact with amendments Section
723 of Article 11 of the Code of Public Local Laws of
Maryland (1930 Edition), title "Frederick County, " sub-
title "Sheriff, " relating to the duties and compensation
of the Sheriff of Frederick County and authorizing him
to appoint deputies, fixing their compensation and pro-
viding for the disposition of fees of the Sheriffs office.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 723 of Article 11 of the Code of
Public Local Laws of Maryland, (1930 Edition), title
