sum as the Mayor and Councilmen shall designate, but in
no event less than the sum of four thousand dollars, and
who shall pay moneys only on the order of the Mayor and
Councilmen.
SEC. 2. And be it further enacted, That this Act is
hereby declared to be an emergency law and necessary for
the immediate preservation of the public health and safety,
and being passed by a yea and nay vote, supported by
three-fifths of all the members elected to each of the two
Houses of the General Assembly, the same shall take effect
from the date of its passage.

CHAPTER 42.
AN ACT to repeal and re-enact with amendments Sections
55 and 56 of Chapter 96 of the Acts of 1922 of the Gen-
eral Assembly of Maryland (said sections being also
known as Sections 55 and 56 of the Charter of Cumber-
land and codified as such in Article 1A of the Code of
Public Local Laws of the State of Maryland, as author-
ized by Chapter 193 of the Acts of 1929 of the General
Assembly of Maryland); Section 55 empowering the
Mayor and City Council to assess property, to levy and
collect taxes, to borrow money under certain limitations,
and providing a penalty for violation; Section 56 em-
powering the Mayor and City Council of Cumberland to
operate the water system of said city, to fix rates for
water, to sell excess water, to borrow money for the use
of the Water Department under certain limitations, and
providing a penalty for violation; this Act being declared
to be an emergency measure.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 55 of Chapter 96 of the Acts of
1922 of the General Assembly of Maryland be, and the
same is hereby repealed and re-enacted, with amendments,
so as to read as follows:
