and to follow immediately after Section 65 of said
Article, prohibiting the use of purse and buck nets or
any similar destructive device for catching fish in Po-
tomac River.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That a new section be added to Article 39 of
the Code of Public General Laws of Maryland, title "Fish
and. Fisheries, " sub-title "Concurrent Law on the Potomac
River, " said new section to be known as Section 65A and
to follow immediately after Section 65 of said Article and
to read as follows:
Section 65A. The use of any purse or buck net or any
similar destructive device is absolutely prohibited in the
waters of Potomac River at all times. Any person, firm or
corporation violating the provisions of this section shall
on conviction thereof before any justice of the peace of any
county of this State, most accessible, forfeit said net or
nets, or device, together with all boats, vessels and tackle
used in the violation of this section and be fined a sum of
not less than three hundred dollars and not more than one
thousand dollars, or to be subject to both fine and for-
feiture, in the discretion of the justice of the peace trying
the case.
SEC. 2. And be it further enacted, That the provisions
of this Act shall not take effect until a similar Act be-
comes effective in the State of Virginia, whereupon the
Governor of Maryland shall issue a proclamation declar-
ing the provisions of this Act to be effective and provided
further that until this Act becomes effective the provisions
of Chapter 175 of the Acts of 1931, prohibiting the use of
a purse or buck net in any waters of the State of Mary-
land, shall continue in full force and effect.
SEC. 3. And be it further enacted, That this Act shall
take effect June 1, 1933.
