405A. It shall be unlawful for any person or persons, to
set, place or maintain any snare, dead-fall, steel trap or
other similar device, within the limits of Montgomery
County, Maryland, for the purpose of taking or catching
any game animal, game bird or fur-bearing animal, in said
Montgomery County, Maryland.

405B. Nothing in this sub-title shall be construed as to
prevent any owner or tenant of any dwelling house in
Montgomery County, Maryland, while so occupied, from
setting or placing steel traps, or similar devices, within 30
yards of such house, or out building continguous thereto,
for the purpose of protecting their domestic fowls from
destruction or damage by predatory animals and birds.

405C. Any person or persons violating the provisions of
this sub-title, shall be deemed guilty of a misdemeanor, and
upon the conviction thereof before a Justice of the Peace
in Montgomery County, shall be fined not less than $10. 00
nor more than $25. 00 for each and every offense, and be
imprisoned in the County Jail until such fine and costs are
paid in full; all of said fines shall be paid to the Conserva-
tion Department of Maryland and placed to the credit of
the State Game Protection Fund; provided, however, that
any person or persons who fail to pay any such fine im-
posed, shall be committed to the County Jail, for not less
than ten days nor more than twenty-five days, for each
offense.

SEC. 2. And be it further enacted, That all Acts or
parts of Acts, general or local, inconsistent with the pro-
visions of this Act, be and the same are hereby repealed to
the extent of such inconsistency.

SEC. 3. And be it further enacted, That this Act shall
take effect June 1, 1933.
