AND WHEREAS on April 1st, 1932, there was a large float-
ing indebtedness in the Water Department of the City of
Cumberland caused partly by operating losses during the
two years ending April first, 1932, and partly by certain
capital expenditures, and whereas it is inadvisable to in-
crease the water rates to the extent necessary to pay off
said floating indebtedness in a short period of time, since
said water rates have recently been increased in 1932 to
take care of the additional overhead caused by the build-
ing of said new dam, and to prevent any further operating
loss;
AND WHEREAS the road supervisors of Cumberland Val-
ley Township, Bedford County, Pennsylvania, are claiming
the Evitts Creek Water Company is legally bound to re-
surface the new road extending along the west side of the
Thomas W. Koon Dam for a distance of about 9000 feet,
which road replaced a dirt road flooded by the building
of said dam, and the cost of which hard surfacing will be
approximately $10; 000. 00, which the Evitts Creek Water
Company may be compelled to do, although it disputes its
legal liability to surface said road; and whereas the Board
of Education of Allegany County, Maryland, claims ap-
proximately $1, 000. 00 is due by the Mayor and City Coun-
cil of Cumberland on account of the cost of a water line to
Gephart School laid by said Board and which line has
since been taken over by the Mayor and City Council of
Cumberland along with all other water lines in the vari-
