CHAPTER 157.

AN ACT to cancel special assessments levied for street
improvements against property abutting upon certain
streets in the Bethesda area of the suburban district of
Montgomery County, and to authorize the County Com-
missioners of Montgomery County to levy a new assess-
ment against said property, and to pay the difference
between the cost and the new assessment, out of any
fund available for the purpose.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the special assessments, heretofore levied
by the County Commissioners of Montgomery County,
pursuant to the provisions of Chapter 459 of the Acts of
the General Assembly of 1931, for street improvements,
against the property abutting upon Elm Street between
Wilson Avenue and Arlington Road, Bethesda Avenue be-
tween Wisconsin Avenue and Arlington Road, Arlington
Road south of Hampden Lane, and Reed Street between
Elm Street and Bethesda Avenue, within the Bethesda
Area of Montgomery County Suburban District, is hereby
cancelled, and the County Commissioners of Montgomery
County are directed to levy a new assessment against all
of the property abutting upon the streets above described
for such an amount as they may determine to be a reason-
able benefit to such property, not exceeding the total cost
of said improvements, under the provisions and according
to the methods and procedure prescribed by said Chapter
459, which new assessment shall have the same force and
effect of the original assessment, and shall be deemed to
come within the provisions of all of the laws and resolu-
tions applicable thereto.

SEC. 2. That, in the event the amount of said new levy
is less than the total cost of the street improvements, any
difference shall be paid out of any fund available vfor the
purpose, by said County Commissioners.

SEC. 3. That this Act is hereby declared to be an
emergency law and necessary for the immediate preserva-
tion of the public health, safety and welfare, and being
passed by a yea and nay vote, supported by three-fifths of
all the members of the two Houses of the General As-
sembly, shall take effect from the date of its passage.
