said Justice of the Peace to forthwith notify the State's
Attorney for said county of the name of such person and
the character of the charges against him, and said Justice
shall not proceed to try said case within a less period than
five days from the date of sending the notifications, un-
less he should sooner receive information from said
State's Attorney, also waiving a jury trial therein, on the
part of the State, in which event he may proceed at any
time to try such case, and the failure to receive any noti-
fication from the said State's Attorney at the expiration of
said period of five days shall be deemed a waiver on the
part of the State to its right of a jury trial.

403. The Justices of the Peace in Baltimore County
shall be entitled to charge for their services in crimi-
nal cases the following fees: For issuing each State
writ, twenty-five cents; and for issuing summons for wit-
nesses, including all witnesses ordered by the same party
or side at one time, twenty-five cents, provided that if
more than five witnesses be ordered by the same party or
side at one time, then the Justices of the Peace shall be
entitled to receive twenty-five cents additional for each
five witnesses, or less than five so summoned; for each
oath or affidavit, ten cents; for each hearing or trial, one
dollar; for every commitment, twenty-five cents; for every
release, twenty-five cents; for taking recognizances, in each
case reported to the Circuit Court, twenty-five cents; for
taking recognizance in each case for hearing or trial before
a Justice of the Peace, twenty-five cents; for taking recog-
nizances of all witnesses in any one case, twenty-five cents
each; provided that no recognizances for the appearance
of any witness shall be taken unless the Justice of the
Peace be satisfied that the same is absolutely necessary to
secure the ends of justice and the attendance of such wit-
nesses; for each attachment for contempt, twenty-five
cents; and that no Justice of the Peace other than the
Justices selected to sit as committing magistrates at Ca-
tonsville, Fullerton, Pikesville, Towson, Dundalk, Essex,
and Halethorpe, shall be entitled to receive from said
County Commissioners more than ten dollars as fees for
his services in criminal cases in any one month. The Jus-
tices selected to sit regularly at the various Station Houses
shall receive from the County Commissioners monthly the
following sums, to wit: The Station House Justice at Pikes-
ville, the sum of One Hundred and Twenty-five Dollars; the
Station House Justice at Dundalk, the sum of Seventy-five
Dollars; the Station House Justice at Catonsville, the sum
