and eighty-seven, of article one, of the Code of
Public Local Laws, of volume two, title, "Allegany
county, " be, and the same is hereby repealed, and
the following enacted in lieu thereof:

Incorporated.

72. The citizens of Frostburg, Allegany coun-
ty, are a body corporate by the style and title of
of the Mayor and Councilmen of the town of Frost-
burg, and by that name may sue and be sued, and
have and use a common seal.

Limits.

73. The limits of said town shall extend
from the German Lutheran church on the National
Road east, to the house inclusive, occupied by
Samuel Leighty, in the year eighteen hundred and
sixty-six, on the west of said town, and one half
mile each way north and south from the house oc-
cupied by Peter Payne, in the year eighteen hun-
dred and sixty-six.

Election of
Mayor.

74. The free male white citizens of Frost-
burg of the age of twenty-one years and upwards,
who have resided in the said town for six months
next preceding the election, shall, on the first Mon-
day in June annually, at the council chamber in
said town, elect one person residing therein, hav-
ing real and personal property in said town to the
value of three hundred dollars, Mayor of Frost-
burg.

Election of
Councilmen,

75. The person qualified as required by the
preceding section shall also, at the same time and
place elect five persons, who shall have resided in
said town one year next preceding said election,
and who shall be assessed on the books of said
town, as Councilmen of said town.

Election in
case of vacan-
cy.

76. In case of death, refusal to act, resigna-
tion or disqualification of the Mayor or any of the
Councilmen, the Councilmen or the remaining
Councilmen shall direct an election to be held to
fill such vacancy, and the Mayor and Councilmen,
or the Councilmen in case of a vacancy in the office
of Mayor, shall give at least ten days notice of all
elections to be held for said town, by notices posted
up in several of the most public places therein.

Oath,

77. The Mayor and Councilmen shall meet
at the council chamber on the second Monday in
June next preceding the election, and the said
Councilmen shall, before they enter upon the duties
