license to any person to sell spirituous or fermented
liquors of any kind at any place within three miles
of either of the churches in the village of Wolfs-
ville, Frederick county, Maryland, and that any
person selling any spirituous or fermented liquors
or any other kind of intoxicating drinks, whether
of original manufacture or of a mixed character,
within the above described limits, shall, on convic-
tion, be subject to the same fines and punishments
now prescribed by the Code of Public General Laws
of Maryland for selling spirituous or fermented li-
quors without license.

Sec. 2. And be it enacted, That this act shall
take effect from the date of its passage.

CHAPTER 105.

AN ACT to repeal section thirty-eight, of article
twenty-eight, of the Code of Public General
Laws, of the State of Maryland, and re-enact
the same with amendments.

SECTION 1. Be it enacted b t the General Assembly
of Maryland, That section thirty-eight, of article
twenty-night, of the Code of Public General Laws,
entitled, "Private Roads, " be repealed and re-
enacted so as to read as follows:

Repealed.
|
Sub-Section 33. Any owner or owners of a mill,
factory, distillery, quarry or lime kiln, situated
within one mile of any railroad, may apply to the
county commissioners of the county to lay out and
open a private road from each mill, factory., dis-
tillery, quarry or lime kilns, to the most conveni-
ent place for intersecting such railroad, and on
such application the county commissioners, shall
proceed in the same manner and with the same
powers as if such application were for a private
road to a farm.
