in the land about to be condemned, by personal
service of such notice, on him or them, or by leav-
ing such notice at his or their place of abode, or by
inserting the same for three successive weeks in
some newspaper published in Centreville; pro-
vided, the said Turnpike Road shall not pass
through the house, yard, grist-mill or saw-mill of
any person, or any other tenement, or orchard, or
garden.

Power to
make road.

Sec. 6. And be it enacted, That upon the Pre-
sident and Directors paying to the owners of the
said land the sum so awarded by the jurors afore-
said, as the case may be, they shall have power to
cut, dig and make the Turnpike Road aforesaid,
through such land, in the same manner as if the
consent of the owner had been given thereto, and
that the said President and Directors shall be em-
powered to erect and make bridges and viaducts
over all such streams or water courses as may be
thought necessary for the benefit of said Turnpike
Road, so as not to obstruct the free currant of said
streams or water courses.

Shares to be
considered
personal es-
tate

Sec. T. And be it enacted, That the shares of
stock of said company shall be taken and consider-
ed as personal estate, and the President and Di-
rectors may provide the mode of transferring said
stock, and of furnishing evidence of the ownership
thereof, and such stock in all general meetings of
the said company, may be represented and voted
either by the owner or owners thereof, or by proxy,
by such owner or owners appointed and authorized
in writing, and the said President and Directors
shall have the power to erect toll-gates upon the
said Turnpike Road, at such point or points as
they may deem necessary or advisable, and shall
have the power to fix the amount or rate of tolls to
be paid by persons using or passing along on said

road; provided, the said rates of tolls shall not ex-
ceed that now charged on the Marsh Turnpike
Company, of Washington county, but the said rate
rate of tolls may be at any time altered and regu-
lated by the General Assembly of this State.

Sec. 8. And be it enacted, That as soon as the
President and Directors of said company shall be
elected, they shall have power to collect and
receive the subscriptions so made to said capital
stock, and in case any subscriber thereto shall fail
