Chapter 273.

AN ACT to protect a class of small birds known as
|
 
|
Song or insectivorous birds in Worcester county.
|
 
|
SECTION 1. Be it enacted by the General Assem-
|
 
|
bly of Maryland, That it shall be unlawful here-
|
 
|
after for any person at any time to trap or capture,
|
 
|
shoot or otherwise kill, or injure, or pursue with such
|
 
|
intent any of the following named birds within the
|
 
|
limits of Worcester county, viz: Blue-bird, thrush,
|

martin, mocking-bird, swallow, oriole, red-bird, cat-
|
injure.

bird, sparrow, whipporwill, wren, pewit, goldfinch,
|
 
|
sapsucker, ground-robin, hanging-bird, or wood-
|
 
|
pecker, or any song or insectivorous birds; provided
|
 
|
that nothing contained in this act shall be so con-
|
 
|
strued as to prevent the killing or capture of crows,
|
 
|
blackbirds or birds of prey.
|
 
|
SEC. 2. And be it enacted, That it shall be un-
|

lawful for any person knowingly and unnecessarily
to destroy or disturb the eggs of any of the birds
|

protected by the provisions of this act.

|
SEC. 3. And be it enacted. That any person viola-
|
 
|
ting any of the provisions of this act shall, on con-
|
 
|
viction thereof, be fined in any sum not less than
|
 
|
two dollars and not more than ten dollars for each
|
 
|
offence, with costs of prosecution; and all prosecu-
|
 
|
tions under this act shall be in the name of the State
|

in which such violation may occur; and all fines,
|
 
|
when collected under this act, one half thereof shall
|
 
|
be paid to the informer and the other half to the
|
 
|
county commissioners of said county, to be applied

|
county.

SEC. 4. And be it enacted, That the possession by
|
 
|
any person within said county of any of the birds
|
