SEC. 2. And be it further enacted, That if the

 

said Mayor and City Council of Baltimore cannot

 

agree with the said owner or owners, or if there be

 

any incapacity or disability on the part of the

 

said owner or owners, to contract, or if such owner

 

or owners shall be absent, out of the State or

 

unknown, application may be made by the said
