Chapter 333.

AN ACT to repeal chapter three hundred and
|
 
|
seventy-eight of the acts passed at the January
|
 
|
session, eighteen hundred and seventy-six, as
|
 
|
amended by chapter six of the acts passed at the
|
 
|
January session, eighteen hundred and seventy-
|
 
|
eight, entitled "An Act to protect fish in the
|
 
|
Black Water River, in Dorchester County," and
|
 
|
to enact the following in lieu thereof.
|
 
|
SECTION 1. Be it enacted by the General Assem-
|
 
|
bly of Maryland, That chapter three hundred and
|
 
|
seventy-eight of the acts passed at the January ses-
|
 
|
sion, eighteen hundred and seventy-six, as amended
|
 
|
by chapter six of the acts passed at the January
|

"An act to protect h'sh in the Black Water river, in
|
 
|
Dorchester county," be and the same is hereby re-
|
 
|
pealed, and the following enacted in lieu thereof.
|
 
|
SEC. 2. And be it enacted, That it shall be un-
|
 
|
lawful for any person or persons to use patent twine
|
 
|
weirs, or other twine weirs, pound nets or fykes, for
|
 
|
the taking or catching of fish in the following waters
|
 
|
in Dorchester county, Fishing bay, Transquakin
|
 
|
river, Honga river, Fishing creek, Church creek,
|
 
|
(said creeks being tributaries of the Little Choptank
|

river), Black Water river and Little Black Water
|
lawful.

river, or to fasten or stick stakes, poles or other ob-
|
 
|
structions in that part of the Black Water river lying
|
 
|
between a line drawn from Grog point to the oppo-
|
 
|
site side of the river, and a line drawn from Booges
|
 
|
ditch to the opposite side of the river, except in the
|
 
|
bends of said river where stake weirs now exist.
|
 
|
SEC. 3. And be it enacted, That any person or
|
 
|
persons who may violate any of the provisions of
|
 
|
-this act shall, upon conviction thereof, before any
|
 
|
justice of the peace of said county, be fined for each
|
 
|
and every offence the sum of fifty dollars and costs
|

of prosecution, and be committed to the county jail

until said fine and costs are paid, and the condemna-
|
 
|
tion and forfeiture of the patent twine weirs, weirs,
|
 
|
pound nets or fykes, and boats or canoes used in

the violations set forth in the aforegoing sections,
|
