in the constructing of said railroad over and upon

the said Light street bridge, iron or steel rails having
|
 
|
a flange less than six inches wide shall be used; and
|
 
|
the said company shall, at its own cost and expense,
|
 
|
construct and keep in repair an extra floor to cover

bridge, which said extra floor shall cover the entire
|
 
|
space between the rails, and to be raised to the level

of the tops of said rails.

SEC. 7. And be it enacted, That the said company
|
 
|
be and they are hereby authorized, in the construct-
|
 
|
ing of said railway over the county road aforesaid,
|
 
|
to alter the grades of said road, and shall have the
|

power to widen the limits of said road to a width

requisite for the purposes of the construction of said
|
 
|
railway; and whenever said company shall deter-
|
 
|
mine to widen said road, and when it becomes
|
 
|
necessary to occupy new grounds for the purposes

aforesaid, or for the purpose of erecting the neces-
|
 
|
sary depots, stables and other buildings requisite for
|
 
|
the enjoyment and operating of said railway, or to
|
 
|
use new materials, and the consent of the owner
|
 
|
or owners of said ground or materials cannot be ob-
|
 
|
tained, a jury shall be summoned by the sheriff of
|

Anne Arundel county, upon a warrant of a justice

|
of the peace of Anne Arundel county, for that pur-
|
 
|
pose, to be issued upon the application of said com-
|
 
|
pany, to condemn said land and materials, and assess
|
 
|
the damage, in which assessment the benefits or ad-
|
 
|
vantages, if any, of the widening of said road, and
|
 
|
the occupying of said ground, shall be considered by
|
 
|
the jury, and the inquisition thereupon taken shall
|
 
|
be signed by the sheriff and jury, and be returned
|
 
|
by said sheriff to the Circuit Court for Anne Arun-
|
 
|
del county; and unless good cause be shown against
|
 
|
said inquisition of the jury, it shall be confirmed by
|
 
|
said court at the term next after the return of
|
 
|
said inquisition, and be recorded; and upon pay-

ment, or tender of payment, of the damages assessed

|
by said inquisition, said company shall proceed to
|
 
|
occupy and possess the land so condemned for the
|
 
|
purposes aforesaid; but if the said inquisition shall be
|
 
|
set aside, the said court may, in its discretion, as often
|
 
|
as it may be necessary, direct another or other in-
|
 
|
quisitions in the manner above described.
