822 JOURNAL OF PROCEEDINGS [Mar. 29,

At 8.25 P. M., the contestant, Mr. Wilson, proceeded to
address the Senate.

At 8.55 P. M., the sitting member, Mr. Duke, submitted
a written argument.

Which was lead by the Clerk.

Mr. Hepbron submitted the following Resolutions as a sub-
stitute for the Report and Resolution, reported by the Com-
mitte on Elections.

Resolved, That Nathaniel Duke was not duly elected as
State Senator for Calvert county, and is, therefore, not en-
titled to a seat in this body.

Resolved, That Joseph A, Wilson having received the
highest number of votes cast for Senator, for Calvert county,
is declared by this body duly elected and entitled to a seat as
Senator for said county.

Pending the consideration of the above Resolutions,
On motion by Mr. Cooper,

The further consideration of said Resolutions were post-
poned until to-morrow (Thursday) evening, at 8 P. M.

Mr. Ford, from Select Committee, reported favorably,

Senate bill entitled an Act to repeal Sec. 70 of Art. 17, of
the Code of Public Local Laws, title "Queen Anne's county,"
sub-title "crier," and to re-enact the same with amendments.

Which was read the first time.
On motion by Mr. Ford,

The rules were suspended, so as to give said bill a second
reading, this day, by yeas and nays as follows:

Bannon, Joyce,

Brewer, Lawrence,

Cooper, Lloyd,

Said bill was then read the second time and ordered to be
engrossed for a third reading.
