That said McCardle, in testifying before your Committee,
asserted that his information was wholly derived from a Di-
rector in the said Canal Company; but being asked the name
of said Director, he absolutely refused to give the name of
said Director.

Your Committee; is advised that it is doubtful whether it
has power to compel the said witness to testify, or to ask his
committal to jail for refusing to testify; and it has, therefore,
caused a leave to issue from the Senate to bring in a bill as
asked, remedying the defect in our Code in this particular,
by giving by an Act of Assembly, the same powers to the
Senate and its Committees, as have been given by Act of
Congress to the Senate of the United States, and its Com-
mittees.

Tn the meantime, your Committee having the power to test
the truth or falsity of the statements of the said McCardle by
the examination of all of the Directors and Bondholders of
the said Chesapeake and Ohio Canal Company, will proceed
to investigate fully the matter referred to them, and will
hereafter report thereon.

County Commissioners of Cecil county, of the State's interest
in the Bohemia Bridge Company,

Was read the second time and ordered to be engrossed
fer a third reading.

Senate bill entitled an Act to protect fish and wild fowl in
certain of the waters of Kent county,

Was read the second time and ordered to be engrossed for
a third reading.

Senate bill entitled an Act relating to Justices of the
Peace in and for Garrett county,

Was read the second time and ordered to be engrossed for
a third reading.

Senate bill entitled an Act to authorize the County Com-
missioners of Washington county to fund certain indebted-
ness of the Board of County School Commissioners of Wash-
ington county, by issuing bonds therefor, and to levy a tax
for the payment of the same,

Was read the second time and ordered to be engrossed for
S third reading.

Senate bill entitled an Act to prevent the increase of gates
on the public roads of Calvert county,

Was read the second time and ordered to be engrossed for
a third reading.
