100 JOURNAL OF PROCEEDINGS [Jan. 26,

eral election held on the Tuesday after the first Monday in
November, in the year eighteen hundred and seventy-one,
your memorialist was elected by the legally qualified voters
of the counties of Montgomery nnd Frederick, constituting
the Sixth Judicial Circuit, Chief Judge of said Circuit,
"for the term of fifteen years, etc." or "until he shall have
attained the age of seventy years, whichever may first
happen."

Your memorialist further shows, that he was duly com-
missioned and qualified, and has since discharged the duties
of Chief Judge of said Judicial Circuit, and those of an Asso-
ciate Judge of the Court of Appeals.

Your memorialist further shows, that, he was born on the
twenty-third of June 1807, and will (if his life is prolonged)
attain the age of seventy years, on the 23d of June, 1877,
when his term of service will expire, unless it is extended
by your Honorable Bodies, pursuant to the 3d Section of the
4th Article of the Constitution; which provides, "but in
case of any Judge, who shall attain the age of seventy years
whilst in office, such Judge may be continued in office by the
General Assembly, for such further time as they may think
fit, not to exceed the term for which he was elected, by a
Resolution to be passed at the Session next preceding his at-
taining said age."

Tour memorialist, respectfully submits his case to the
consideration of the General Assembly, and prays his term
of office may be extended for such further time as they may
think fit, if not inconsistent with the public welfare.

And your memorialist as in duty bound, will ever pray.

Ordered, That the State Librarian be, and he is hereby
directed to furnish to the members and officers of the Senate
portfolios for the use of their desks.
