So the amendment was rejected.
Mr. Baldwin offered the following amendment:
Substitute the following, for Sections 2 and 3,
SEC. 2. And be it enacted, That it shall be lawful for any
person, and the duty of the constables in the several districts
to take up and impound any horse, mule, horned cattle,
goats or swine which may be found going at large within
said described limits , and such person may, or constable
shall convey such stock to the pound nearest the place when
found running at large.
SEC 3. And be it enacted, That the County Commissioners of
Baltimore county upon application made to them shall appoint
as many pound-keepers for each of the several districts or
parts of districts embraced within the provisions of this law,
as may be necessary; .provided, however, that such pound-
keepers shall receive no compensation from the County Com-
missioners, but shall be paid for their services out of the fines
hereinafter provided for; and provided further, that the
pounds which may be established in accordance with the pro-
visions of this law, shall be at least one mile and a half dis-
tant from each other. The pound-keepers so appointed shall
provide a suitable place for keeping the stock which may be
brought to them to be impounded, and shall properly feed
and care for the same while in their custody. Immediately
upon any stock being brought to any pound, the pound-
keeper shall post or cause to be posted in three prominent
places in the neighborhood notices of the impounding of such
stock, with a description of the same. The owner or owners
of any such stock may release the same by the payment of the
reasonable and customary expenses incurred in the support
and care of such stock while so impounded, and by the pay-
ment of a fine of one dollar for each head of stock so released,.
