said books the pendency of other litigations in which the
Company was engaged with private persons, which made
the publication of the book entries of the Company at this
time injudicious.
The non-production of the said books was not, however,
important ia the opinion of your Committee, because the
State, as a stockholder in said Company, has power, by prop-
er proceedings, to compel a disclosure of the expenditures of
such money, and of all other matter material to the interests
of the State as such stockholder; and such inquiries are best
madund er the order of the Court having jurisdiction of the
cause and competent to afford remedy.
Your Committee, in submitting the results reached by its
entire investigation, have deemed it proper to recommend to
the General Assembly to require the Attorney General to in-
stitute such legal proceedings as may be necessary to secure
the proper application of the money subscribed to the stock
of the said Company, and the interest of the State in said
Company.

To the Joint Special Committee of the Maryland Senate
and House of Delegates in the investigation of the Southern
Maryland Railroad Company:
Gentlemen :
The undersigned, Treasurer of Maryland, during the term
of two years, beginning February 10, 1872, having been in-
formed that some of the members of your Committee have ex-
pressed a desire that I should state such facts as were within
the scope of my knowledge concerning the transactions of the
Treasury Department of the State with the Southern Mary-
land Railroad Company, I beg leave to submit the following
