CHAPTER 440.

AN ACT to repeal and re-enact with amendments Section 15
of Article 2B of the Code of Public General Laws of Mary-
land (1935 Supplement), title "Alcoholic Beverages", sub-
title "Classes of Licenses", prohibiting refunds on retail
licenses for sale of alcoholic beverages in Baltimore City.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 15 of Article 2B of the Code of Public
General Laws of Maryland (1935 Supplement), title "Alco-
holic Beverages", sub-title "Classes of Licenses", be and the
same is hereby repealed and re-enacted with amendments to
read as follows:

15. LICENSE FEES — REFUNDS. When any licensee shall
cease to carry on the business for which a license has been
obtained, and shall surrender such license to the official
issuing the same, for cancellation, and shall make affidavit
that he has fully complied with all provisions of law and all
regulations during the time that such license has been in
effect, and that no indictment or complaint is pending against
him in any court of this State, or before any Board of License
Commissioners or the Bureau of Licenses, he shall be entitled
to a refund of the unearned portion of the fee paid for such
license, if provision therefor is made in Section 14 of this Act,
and such refund shall be payable from the funds and in the
manner therein provided. Provided that no holder of any
class of license for the sale of beer in Ocean City in Worcester
County shall be entitled to a refund of the unearned portion
of the fee paid for such license, and provided further that no
holder of any class of retail license in Baltimore City shall be
entitled to a refund of the unearned portion of the fee paid
for such license except it be in the event of receivership or
bankruptcy of his business or in the event of the decease of
the license holder when all such refunds shall be returned to
the creditors or estate of any such licensee.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1937.

CHAPTER 441.

AN ACT to add a new section to Article 93 of the Annotated
Code of Maryland (1935 Supplement), title "Testamentary
Law", sub-title "Account", said new section to be known as
