128. The Mayor and Council shall have power to levy, on or
before the 30th of June for each year, the tax year commenc-
ing the first day of July, taxes at such rates as they may find
necessary for anticipated expenses for the coming fiscal year,
not to exceed five cents on the one hundred dollars assessed
valuation, for the first year, nor more than twenty-five cents
on the one hundred dollars assessed valuation thereafter, based
on the State and County assessments for all purposes, and all
taxes so levied shall be a lien on any and all property of the
person, company or corporation against whom they may be
levied, and the taxes for each year are payable on the first
day of July next succeeding the levy thereof, and will be in
arrears and subject to a legal interest from and after that
date.

SEC. 2. And Tie it further enacted, That this Act shall not
become effective unless and until it shall be submitted to the
qualified voters living within the corporate limits of the town
of Brentwood as the same exists at the time of passage of this
Act at a referendum election and accepted by a majority of
the persons voting at said election for such purpose, the said
referendum election of the qualified voters shall be held by the
Mayor and Common Council of Brentwood at the same time
the next election for municipal officers is held in said town
and said election shall be conducted under the provisions of
existing laws for the election of town officers and in accor-
dance with such ordinances as may have been adopted or shall
be adopted by the Mayor and Common Council of Brentwood,
not inconsistent with law, for the submission to the voters of
said municipality of the provisions of this Act, and the man-
ner of the submission of the question to the voters shall be that
on the ballots of such election, there shall be printed the words
"For Increase in Tax Levy" with a blank square opposite at
the right, and the words "Against the Increase in Tax Levy"
with a blank square opposite at the right, and all qualified
voters desiring to vote for the provisions of this Act shall
place a cross mark (x) in the square opposite the words "For
Increase in Tax Levy", and all qualified voters desiring to
vote against the provisions of this Act shall place a cross
mark (x) opposite the words "Against the Increase in Tax
Levy". If, at such election, a greater number of votes shall be
cast "For the Increase in Tax Levy" than shall be cast
"Against the Increase in Tax Levy", then the provisions of the
foregoing Section of this Act shall become effective and the
effective date of the provisions of this Act, in the event the
same is approved at said election, to be the date that the said
Mayor and Common Council of Brentwood shall declare the
result of said election in accordance with the provisions of
law or ordinances as provided herein.
