Commissioner. In the case of a tie vote a run-off election shall
be held to choose between the tied candidates, such election to
be called by the Election Supervisors at the earliest date such
election can legally be held.

Sub-section (T) of Section 10. That in case any person so
elected to the office of Commissioner shall fail so to qualify, or
in case of any vacancy in the office of Commissioner by death,
resignation or otherwise, the remaining Commissioners shall
fill such vacancy by appointment to serve until the next
annual election, and if the term of said Commissioner does
not regularly expire at that time, then a successor to fill out
the unexpired term shall be elected at said annual election.
Any person so appointed shall possess the qualification stated
in this Act, shall be a resident of the Town of District Heights,
and shall qualify by taking the oath of office within three (3)
days after his said appointment.

Sub-section (U) of Section 10. That in making appoint-
ment to fill any such vacancy in the office of Commissioner the
remaining qualified Commissioners shall make such appoint-
ment by entering in the minute books of said Commission the
fact of their making such appointment, and the same day no-
tifying the person so appointed of his said appointment.

SEC. 2. And Tie it further enacted, That all Acts and parts
of Acts inconsistent with any of the provisions of this Act are
hereby repealed to the extent of their inconsistency.

SEC. 3. And, be it further enacted, That if any part or pro-
vision of this Act shall be held unconstitutional or invalid or
unenforceable, the same shall not affect the remaining parts of
this Act.

SEC. 4. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and being
passed by a yea and nay vote supported by three-fifths (3/5)
of all the members elected to each of the two Houses of the
General Assembly, the same shall take effect from the date of
its passage.
