claimed or received by him, directly or indirectly. If the
treasurer, or any clerk, agent or deputy shall violate this
Section, or any other section of this Act, the person so
offending shall be deemed guilty of a misdemeanor, and,
upon conviction thereof, shall pay a fine of not less than f 100,
nor more than $500, for each and every offense, one-half thereof
to the school fund of said county. The said salary and com-
pensation so allowed shall not be retained by the treasurer
out of the collections made, but shall be paid him by the clerk
by check, as other claims are paid. Provided, that the change
in the basis and amount of the compensation of the treasurer,
as hereinbefore prescribed and limited, shall not become effec-
tive during the term of office for which the incumbent was
elected, but that during said term, the compensation and basis
thereof shall remain under the present law.

SEC. 2. And be it further enacted, That on account of the
importance of the work in the Office of the County Treasurer
the County Commissioners be and they are hereby authorized
to make immediately available sufficient funds out of any un-
appropriated monies in their hands; provided, however, if
funds are not available for this purpose then the said County
Commissioners shall include in the levy for the year 1938 a
sufficient sum to pay the increases provided for by this Act
from the date on which it becomes effective.

SEC. 3. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and having
been passed by a yea and nay vote, supported by three-fifths
of all the members elected to each of the two Houses of the
General Assembly, the same shall take effect from the date of
its passage.

CHAPTER 205.

AN ACT to repeal and re-enact with amendments Section 533
of Article 10 of the Code of Public Local Laws of Mary-
land (1930 Edition), title "Dorchester County", sub-title
' Vienna", defining the powers of the Commissioners of
Vienna and fixing the amount said Commissioners may
borrow on their notes.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 533 of Article 10 of the Code of Public
