Labor" and to follow immediately after Section 104 of said
Article, and to be known as Section 105, to authorize and
direct the State Roads Commission and the Board of Wel-
fare to utilize convict labor of State penal institutions on
reconstruction and maintenance of State and County roads,
and to prescribe certain conditions therefor.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a sub-title and one new section be and the same
are hereby added to Article 89B of the Annotated Code of
Maryland (1935 Supplement), title "State Roads", said sub-
title to be known as "Convict Labor" and to follow imme-
diately after Section 104 of said Article and said new section
to be known as Section 105 and to follow immediately after
Section 104 of said Article, to read as follows:

105. CONVICT LABOR. The State Roads Commission is
authorized and directed to expend a sum of One Hundred
Thousand Dollars ($100, 000. 00) a year for the fiscal
years of 1938 and 1939, from the Reconstruction and Main-
tenance Fund to be used for the purpose of employing, on
reconstruction and maintenance of State and County roads,
prisoners in the penal institutions of the State which institu-
tions are under the control and direction of the Board of Wel-
fare; and the said Board of Welfare is directed to furnish the
said Commission, for the above purposes, such prisoners as in
its judgment may be safely utilized for such work, the Board
to be the sole judge of whether such prisoners can be used for
road work with maximum security.

The employment of all prisoners on road work as herein
directed shall be subject to all the conditions and requirements
now in force for such work, as prescribed in Article 27, Sec-
tions 712 to 726 inclusive of the Code of Public General Laws
(1924 Edition), provided that the money to be expended here-
under shall provide for maintenance, safekeeping, transporta-
tion, wages and all other expenses of utilizing prison labor
on the roads, it being understood this sum shall cover the total
cost of the employment of said prisoners.

It is declared to be the policy of the State that, because of
the enforced idleness of prisoners in the several penal institu-
tions of the State, it is necessary and desirable that useful
work on State projects be found for said prisoners, and that
all such prisoners who may be safely used for this work shall
be put upon maintenance and reconstruction of the State
roads.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1st, 1937.
