"Health", sub-title "Undertakers", creating the State Board
of Funeral Directors and Embalmers in place of the State
Board of Undertakers and amending the law generally.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 290 to 309, inclusive, of Article 43 of the
Annotated Code of Maryland (1924 Edition and 1935 Supple-
ment), title "Health", sub-title "Undertakers", be and they are
hereby repealed and re-enacted with amendments to read as
follows:
2fiO. A board composed of ten members is hereby created
and established, to be known as the State Board of Funeral
Directors and Embalmers of Maryland, and the powers and
duties of the said board prescribed.
291. The members of the State Board of Undertakers of
Maryland as at present constituted shall constitute the
State Board of Funeral Directors and Embalmers of Mary-
land, and shall hold office for the residue of the respective
terms for which they have been appointed. Thereafter
the Governor, by and with the advice and consent of the
Senate, shall biennially appoint seven licensed Funeral
Directors and Embalmers, residents of the State of Mary-
land, who shall have been actively engaged in their profession
for the last five years immediately preceding their appoint-
ment, five of whom shall be residents of Baltimore City and
two residents of the counties, who, together with the Director
of the State Board of Health of Maryland and the Com-
missioner and the Assistant Commissioner of Health of the
City of Baltimore, who shall be ex-officio members, shall con-
stitute the "State Board of Funeral Directors and Em-
balmers of Maryland", and they shall take the oath pre-
scribed by the Constitution of Maryland. The members of the
said Board shall hold office until their successors are duly ap-
pointed and qualified; any vacancy or vacancies occurring in
the membership of the said Board appointed by the Governor
during a recess of the Legislature shall be filled by the Gov-
ernor; subject to confirmation by the Senate at its next session.
292. Each member of said Board, before entering upon his
duties, shall take and subscribe to an oath before the Clerk of
the Superior Court of Baltimore City or the Clerk of the Cir-
cuit Court of any County in the State, that he will faithfully
and impartially discharge the duties of his office without fear,
partiality or favor, and that he will not during his term of
office accept any money, gift, gratuity or consideration what-
soever from any person or persons concerning any matter or
thing connected with the duties of his office. A certificate
