shall exist a vacancy in said office to be filled as hereinafter
provided. The Mayor shall receive a yearly salary of $100.00
and shall serve for a term of two years, or until his successor
is duly installed,
39A. (Duties.) The Mayor shall preside at meetings of the
Council and shall exercise such other powers and perform
such other duties as are or may be conferred and imposed upon
him by this charter and the ordinances of the town, and shall
cast his vote when necessary to decide any issue. He shall be
recognized as the head of the town government for all cere-
monial purposes, by the courts for serving civil processes, and
by the Governor for the purposes of military law. In case of
his absence or disability the Council shall elect from their
members a Mayor pro tern to act in his place, and in case a
vacancy occurs in the office of Mayor it shall be filled in
accordance with Section 55 of this charter. The Mayor shall
enter upon his duties at the first regularly constituted meet-
ing of the Town Council after the declaration of election.
THE COUNCIL
40. (Creation, Salary and Composition of Council.) Except
as otherwise provided in this charter all powers of the town
shall be vested in a Council consisting of two members for
each ward and the Mayor, elected at large from the town in
the manner hereinafter provided. The term of each Council-
man shall be for four years except as hereinafter provided and
until his successor shall have qualified, and shall begin on the
first regular meeting after the Town Council has certified to
their election.
At the first election of the Town Council after the adoption
of this charter, one Councilman from each ward shall be
elected for a term of two years, and the other Councilman
in each ward shall be elected for a term of four years. There-
after, each succeeding Councilman shall be elected for a term
of four years, as above stated. Regular elections for Council-
man will take place every two years.
If a vacancy occur in the Council it shall be filled in accord-
ance with Section 55 of this charter. Each Councilman shall
receive a yearly salary, the amount of which shall be pre-
scribed by ordinance, but not to exceed $ 100.00. Until otherwise
fixed by ordinance such salary shall be $25.00 per year. No
ordinance fixing or changing the salary of Cou'ncilmen shall
become effective during the current term of office of the Coun-
cilmen enacting such ordinance. Councilmen shall be quali-
fied voters of the town and residents of the ward they repre-
