tion), title "Lunatics and Insane," sub-title "Board of Men-
tal Hygiene", relating to the appointment of members of
the Board of Mental Hygiene, and the appointment of the
Commissioner of Mental Hygiene.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 15 of Article 59 of the Annotated Code of
Maryland (1939 Edition) title "Lunatics and Insane," sub-
title "Board of Mental Hygiene," be and it is hereby repealed
and re-enacted, with amendments, to read as follows:
15. (a) There shall be a Board of Mental Hygiene, which
shall have supervision over all institutions, public corporate
or private, in which insane persons are detained, and shall be
vested with and possessed of the powers and duties in this sub-
title specified, and also all powers necessary or proper to
to enable it to carry out fully and effectually all the purposes
of this sub-title.
(b) Said Board of Mental Hygiene shall consist of the Com-
missioner of Mental Hygiene who shall serve as the Chairman
of the Board and six appointed members. The Professor of
Psychiatry at the University of Maryland, the Professor of
Psychiatry at the Johns Hopkins School of Medicine, the Di-
rector of the School of Hygiene of the Johns Hopkins Univer-
sity, the Director of the State Department of Public Welfare,
and the Supervisor of Special Education of the State Depart-
ment of Education shall be advisory members of said Board.
Three at least of said appointed members shall be appointed
from the City of Baltimore, three at least of said appointed
members shall be physicians and graduates of some accredited
medical college, and must also have been in the actual practice
of their profession at least five years consecutively just pre-
ceding their appointment; two of said physicians so chosen
shall have at least five years' experience in the treatment of
the insane; and at least one of said appointed members shall be
a woman. All of the appointed members shall be appointed
by the Governor with the advice and consent of the Senate.
The appointed members of said Board shall hold office for six
years and the members in office on January 1, 1947, shall con-
tinue in office until the expiration of their respective terms.
Thereafter in each case the Governor, with the advice and con-
sent of the Senate, shall appoint members in the place of those
whose terms shall expire. All vacancies shall be filled by the
Governor, with the advice and consent of the Senate .
(c) There shall be a Commissioner of Mental Hygiene who
shall be a qualified physician with at least five years' actual
experience in the treatment of mental diseases. The Com-
