diate preservation of the public health and safety, and having
been passed by a yea and nay vote, supported by three-fifths
of all the members elected to each of the two Houses of the
General Assembly of Maryland, the same shall take effect
from the date of its passage.

CHAPTER 299.
(House Bill 373)

AN ACT to repeal and re-enact, with amendments, Section
157(h) of Article 66 1/2 of the Annotated Code of Maryland
(1943 Supplement), title "Motor Vehicles", sub-title "Oper-
ation of Vehicles Upon Highways", providing, for the estab-
lishment by the State Roads Commission of reasonable
safe prima facie- speed limits upon certain highways and
streets within the State of Maryland.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 157(h) of Article 66 1/2 of the Annotated
Code of Maryland (1943 Supplement), title "Motor Vehicles",
sub-title "Operation of Vehicles Upon Highways", be and
it is hereby repealed and re-enacted, with amendments, to
read as follows:

157.

(h) Whenever the State Roads Commission shall determine
upon the basis of an engineering and traffic investigation that
any prima facie speed hereinbefore set forth is greater than
is reasonable or safe under the conditions found to exist
at any place upon any public highway within this State out-
side the corporate limits of any municipality or upon any
State maintained street within the corporate limits of any
municipality, said State Roads Commission shall determine
and declare a reasonable safe prima facie speed limit thereat
which shall be effective when appropriate signs giving notice
thereof are erected upon any such highway or street. Vio-
lation of the provisions of this sub-section shall constitute
reckless driving, to wit: operating at a rate of speed greater
than is reasonable and proper.

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
