whether stock, mutual, reciprocal, "Lloyd's" or fraternal
association, unless and until both the company and the
individual shall have been duly licensed by the Insurance
Department, provided that unauthorized insurance may be
placed in conformity with the provisions of Sections 96,
97, 98 and 99 of the Insurance Article, and providing
penalties for violations.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 82 of Article 48A of the Annotated Code
of Maryland (1943 Supplement) title "Insurance", sub-title
"Agents and Brokers", be, and the same is hereby repealed
and re-enacted, with amendments, under a changed section
number and to read as follows:

82A. (Agent's Licenses.) It shall be unlawful for any
official, agent, solicitor or other individual to solicit or write
any contract of insurance, as defined by Section 1 of this
Article, on behalf of any domestic or foreign company, whe-
ther stock, mutual, reciprocal exchange, "Lloyd's" or fraternal
association, except as hereinafter exempted, unless and until
said company, reciprocal, "Lloyd's" or association, shall have
been duly licensed by the Insurance Department and au-
thorized to write the class or classes of business so solicited
or written; and said agent or solicitor for a stock or mutual
company, reciprocal exchange or "Lloyd's" shall have duly
qualified and been licensed by the Insurance Department as
general agent, agent or solicitor, by the company for which
he so acts, or shall hold a current broker's or broker's solici-
tor's license issued by this Department. Provided, however,
that unauthorized insurance may be placed in conformity
with the provisions of Sections 96, 97, 98 and 99 of the In-
surance Article; and provided further, that nothing herein
shall be construed so as to apply to any home office executive
of any duly licensed company, or to any association, organi-
zation, or corporation heretofore declared by other provisions
of the Insurance Article now in force to be exempt from
compliance with the provisions of the Insurance Article, or
to the organizers, officials or representatives of any such
exempt association, organization or corporation. Every such
agent's or solicitor's license or permit shall have specified
upon its face the name of the company for which said Agent
or Solicitor is authorized and licensed to act, and all such
permits shall expire at midnight on the 30th day of June
following the date of issue. Each and every violation of any
provision of this section shall be deemed to be a misdemeanor
and shall subject each person found guilty to a fine of not
more than Five Hundred Dollars ($500.00), or imprisonment
