CHAPTER 193.
(House Bill 35)

AN ACT to repeal and re-enact, with amendments, Section
21 (e) of Article 99 of the Annotated Code of Maryland
(1943 Supplement), title "Birds, Game and Inland Water
Fish," sub-title "Upland and Migratory Game Birds and
Game Animals", and Sections 65 (a) and 66 of said Article,
sub-title "Raccoon, Opossum and Skunk", clarifying the
provisions of said sections.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 21 (e) of Article 99 of the Annotated Code
of Maryland (1943 Supplement), title "Birds, Game and
Inland Water Fish," sub-title "Upland and Migratory Game
Birds and Game Animals," Sections 65(a) and 66 of said
Article, sub-title "Raccoon, Oppossum and Skunk", be and
they are hereby repealed and re-enacted, with amendments,
to read as follows:

21 (e). It shall be unlawful to hunt any game at night
time, except raccoon and oppossum. The words "night time"
shall be construed to mean the time beginning with sunset
until sunrise the following day; the time stated by calendar
of hour of sunrise and sunset. It shall be unlawful to hunt
any game, except raccoon and oppossum, mentioned here-
in by use of automobile lights, spotlight, or a light of
any description. It shall be unlawful to hunt, pursue or
kill any upland game of any species, except deer, by means
of any automatic loading or hand-operated repeating shot-
gun capable of holding more than three shells, the maga-
zine of which has not been cut off or plugged with a one-
piece metal or wooden filler incapable of removal through
the loading end thereof so as to reduce the capacity of said
gun to not more than three shells at any one time in the
magazine and chamber combined. Provided, however, a 22
caliber rifle or bow and arrow shall be termed as lawful
weapons for the hunting of upland game, except it shall be
unlawful to hunt elk or deer with a rifle using cartridges
giving a muzzle energy of less than 1200 foot pounds.

65(a). No person shall between February 1 and October
31, inclusive, shake or throw out of any tree or den any rac-
coon or opossum. Every person hunting raccoon or opossum
must have a hunter's license for the current year in posses-
sion and tag displayed on outer garment.

66. Any person or persons found guilty before any Justice
of the Peace of this State of violating any provisions of
