be to require the Commission, out of its road construction
funds, to correct any such conditions.
At the request of the Commission the bill will be vetoed.
BETTERTON
SENATE BILL 226
AN ACT to repeal and re-enact, with amendments, Section
53 of Article 15 of the Code of Public Local Laws of Mary-
land (1930 Edition), title "Kent County", sub-title "Better-
ton", relating to the power of the Commissioners of Better-
ton to pass ordinances levying and fixing license fees, and
excepting the town of Betterton from the provisions of
Section 8A of Article 56 of the Annotated Code of Mary-
land (1943 Supplement).
This bill confers very broad powers on the Commissioners
of Betterton especially with respect to the licensing of any
occupation, profession or trade for such fees as they shall
determine.
The Maryland Commission on the Distribution of Tax Reve-
nues has recommended the licensing of business on a State-
wide and uniform level and the distribution of the revenues
received from such licenses to the political sub-division
where the license fee is collected. The Town of Betterton
will receive funds distributed in accordance with this prin-
ciple which was adopted by the recent Session of the General
Assembly.
Furthermore, the bill calls for the repeal of Section 8A of
Article 56 of the Annotated Code of Maryland (1943 Supple-
ment), insofar as it relates to the Town of Betterton. This
section of the law provides that no local licenses shall be
required for any business or occupation for which a State
license is necessary. It also provides that no occupational
tax or fee shall be imposed upon any person, firm or corpora-
tion transacting business if a State license is required for
such business or occupation.
Since this bill would except Betterton from a uniform
State-wide law, it will be vetoed.
