ministrative Board", said new sections to be known as Sec-
tion 210 and Section 211 and to follow immediately after
Section 209 of said Article, providing for the creation of
an Electrical Administrative Board of Baltimore County
and vesting in said Board the sole jurisdiction of the per-
formance of electrical installations and repairs or the en-
gaging in the electrical contracting or maintenance electri-
cian business in Baltimore County and authorizing the mak-
ing of rules and regulations and fixing of fees governing
the entrance into the electrical contracting or maintenance
business or trade in Baltimore County, and its conduct
therein, subject to approval of the County Commissioners
of Baltimore County, and providing for the issuance or li-
censes by the Electrical Administrative Board of Baltimore
County.
The constitutionality of this bill is questioned by the At-
torney General upon the ground that it constitutes an unlaw-
ful delegation of power to the Electrical Administrative
Board of Baltimore County. This bill establishes that agency
and clothes it with authority to make such rules and regula-
tions for the issuance of licenses, and the examination of
applicants to engage in the electrical trade or business in
Baltimore County and the conduct thereof as deemed neces-
sary, without laying down any rule or guide to control the
Board in its activities. Such broad powers may not be dele-
gated, at least in a case where the Legislature has not pro-
vided the framework within which the Board is to make its
rules and regulations and otherwise govern its activities.
For the above reasons the bill will be vetoed.
HOUSE BILL 678
AN ACT to add nine new sections to Article 3 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Bal-
timore County", sub-title "Motion Picture and Other Pub-
lic Exhibitions", said new sections to be known as Sections
411, 412, 413, 414, 415, 416, 417, 418 and 419, to follow
immediately after Section 410 of said Article, relating to
licensing of public exhibitions and performances for profit
in Baltimore County and the fees therefor, requiring ap-
proval of the Chief of Police of Baltimore County and of
the Buildings Engineer of Baltimore County before the is-
suance of a license, and authorizing revocation of a license
at any time upon withdrawal of approval by either or both
of said officials; and to repeal Section 8A of Article 56 of
the Annotated Code of Maryland (1943 Edition), insofar
as the said section applies to Baltimore County.
