CHAPTER 142
(House Bill 327)

AN ACT to repeal and re-enact, with amendments, Sections 34
and 35 of Article 27 of the Annotated Code of Maryland
(1939 Edition and 1943 Supplement), title "Crimes and
Punishments", sub-title "Burglary", clarifying the provi-
sions of said sections.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 34 and 35 of Article 27 of the Annotated
Code of Maryland (1939 Edition and 1943 Supplement), title
"Crimes and Punishments", sub-title "Burglary", be and they
are hereby repealed and re-enacted, with amendments, to read
as follows:

34. Every person, his aiders, abettors and counsellors, who
shall be convicted of the crime of breaking a dwelling house
in the day time with intent to commit murder or felony therein,
or with intent to steal, take or carry away the personal goods
of another of any value therefrom, or breaking a storehouse,
filling station, garage, trailer, cabin, diner, warehouse or other
out-house in the day or night with an intent to commit murder
or felony therein, or with the intent to steal, take or carry
away the personal goods of another of the value of Twenty-five
Dollars ($25.00) or more therefrom, shall be sentenced to the
penitentiary for not more than ten years.

35. Every person convicted of the crime of breaking into
and shop, storeroom, filling station, garage, trailer, cabin,
diner, tobacco house or warehouse, although the same be not
contiguous to or used with any mansion house, and stealing
from thence any money, goods or chattels to the value of one
dollars or upwards, or as being accessory thereto, shall restore
the thing taken to the owner thereof, or shall pay him the full
value thereof, and shall be sentenced to the penitentiary for
not less than two nor more than ten years.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1947.
