demption of all bonds, any moneys remaining in such special
fund shall be transferred to the General Fund of the Mayor
and Common Council to be used for the general expenses of
the Town.
SEC. 8. And be it further enacted, That if any part, sub-
section, sentence, clause or phrase of this Act shall be held un-
constitutional or void, for any reason, such decisions shall
not affect the validity of the remaining portions of this Act.
SEC. 9. And be it further enacted, That this Act shall not
become effective until it shall have been submitted to the
qualified voters of the Town of Fairmount Heights, in Prince
George's County, at the next regular municipal election, or at
a special election to be held on such date as shall be deter-
mined by the Town Commissioners of said Town. There
shall be printed on the ballots to be used at said election, the
title of this Act and underneath said title on separate lines,
a square or box to the right of and opposite the words ''For
Street Improvement Loan", and a corresponding square or
box to the right of and opposite the words ''Against Street
Improvement Loan", so that the voters shall be able to
designate by a cross mark in the proper square or box his
or her decision for or against said proposed "Street Improve-
ment Loan". If a majority of the votes cast on said question
shall be "For S'treet Improvement Loan", then this Act shall
become immediately effective. If a majority of the votes
cast thereon shall be "Against Street Improvement Loan",
then this Act shall be null and void and of no effect what-
soever.
SEC. 10. And be it further enacted, That this Act shall take
effect June 1, 1947.

AN ACT to repeal and re-enact, with amendments, Section 227
of Article 22 of the Code of Public Local Laws of Maryland
(1930 Edition), title "Washington County", sub-title "Hag-
erstown", as amended by Chapter 267 of the Acts of 1945,
providing that The Mayor and Council of Hagerstown shall
have power to acquire property for public use or municipal
purposes by condemnation proceedings.
