person in default thereof to the County Jail of Montgomery
County for a period not to exceed thirty (30) days, or both
such fine and imprisonment.
SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1947.

AN ACT to repeal Sections 922 and 923 of the Montgomery
County Code (1939 Edition), being Article 16 of the Code
of Public Local Laws of Maryland, title "Montgomery
County", sub-title "Rockville", and to enact in lieu thereof
a new section to be known as Section 922, to follow im-
mediately after Section 921 of said Article, authorizing the
Mayor and Council of Rockville to make street improve-
ments and lay water mains and sewers in said town and
to assess the costs against the property abutting upon said
improvements, and also providing that such costs shall be
a lien upon the property against which assessed; and auth-
orizing the Mayor and Council of Rockville to borrow such
sums as may be necessary to make said improvements and
providing for the payment of all moneys so borrowed.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 922 and 923 of the Montgomery County
Code (1939 Edition), being Article 16 of the Code of Public
Local Laws of Maryland, title "Montgomery County", sub-
title "Rockville", be and they are hereby repealed, and that
a new section be and it is hereby enacted in lieu thereof to
be known as Section 922 of said Article, to follow immedi-
ately after Section 921 of said Article, and to read as
follows:
922. (A) The Council is authorized and empowered when-
ever in its judgment, the public health, safety or comfort
requires it, to grade, construct, re-construct, pave or other-
wise improve any street, sidewalk, alley, curb, curb and
gutter and public highway, or parts thereof, at such time
and to such extent and of such materials and in such man-
ner as shall be provided by ordinance and to lay water mains
and sewers in said town and to pay the costs of all such work
and assess said cost, or any part thereof, against the abut-
ting property as hereinafter provided in this section.
Whenever a petition in writing, duly signed by the owners
of at least two-thirds of the front footage of all the property
