SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 62 and 63D of Article 39 of the Anno-
tated Code of Maryland (1943 Supplement), title ''Fish and
Fisheries", sub-title "Licenses", be and the same hereby are
repealed and re-enacted, with amendments, to read as follows:
62. (When Additional Licenses may be issued.) Prior to
December 1st, 1941, and prior to December 1st in each suc-
ceeding year, the Commission of Tidewater Fisheries shall
make an estimate of the quantity of marketable fin fish of
every species (except eels) that may be available during the
succeeding license year and of the number and types of nets
that may be profitably employed without injury to the fishery.
If the Commission shall determine that additinal nets for the
taking of fin fish (except eels) should be licensed, over and
above the number actually applied for prior to December 1st,
then it shall give public notice, by advertisement once a week
for two successive weeks in one or more newspapers of gen-
eral circulation in the county or counties in which the
licenses will be issued, of the number of additional nets that
may be licensed and of the areas where the same may be
operated and shall state that applications will be received up
to a date to be set by the Commission. An applicant to qualify
for a license must have been issued a license for catching
crabs or oysters for two preceding years with catch records or
sales records proving that he was engaged in the catching of
seafood, or shall submit proof to the Commission that he has
been engaged in or employed in the business of catching fish
commercially for two years. He shall further present proof
satisfactory to the Commission that the catching of seafood
has been his principal occupation for the past two years
during the normal fishing season in his area. Immediately
upon the expiration of the period for receiving applications
the Commission shall issue such additional licenses, within
the limits set, to be chosen by lot from among the qualified
applications received during the period designated for receiv-
ing applications, or from the qualified applications for each
particular area. The Commission shall by regulation fix the
number of nets that may be licensed to any one applicant
under this section.
63D. (Transfer of Licenses.) Any license to operate
pound nets, haul seines, gill nets, or fyke or hoop nets
issued under this sub-title may be transferred whenever the
owner of the nets, boats, gear and other equipment necessary
for their operation, or the personal representative of such
owner, shall sell and convey the same by bill of sale for a
bona fide consideration to any person who is eligible under
